Terms of Service

Agreement

By creating an account or using Electre you agree to these Terms and to our Privacy Policy. If you use Electre for an organisation, you confirm you may bind it, and “you” includes that organisation. You must be at least 18.

The service

Electre gives you a company of AI agents that research, design, build, publish and operate ventures you direct. Agents act on your instructions and within the permissions you give them. You chair the work: you review what they propose and decide what ships.

AI output can be wrong, incomplete or unsuitable. Check anything that matters, including code, legal, financial, medical and safety content, before you rely on it or publish it.

Your account

Keep your sign-in secure and tell us promptly about any unauthorised use. You are responsible for activity in your account and for the people you invite to your organisation.

Credits, subscriptions and payment

• Credits: agents, builds, storage and hosting consume credits at the prices shown in the app when you use them. Purchased credits expire as stated at purchase.
• Subscriptions: renew each period until you cancel, and grant their stated credits and storage each paid period, including any bonus over one-off prices. Cancel at any time in Settings; cancellation takes effect at the end of the paid period.
• Storage and hosting: each organisation has a storage limit set by its plan and add-ons. At the limit, work continues but new saves are refused until you free space or add storage.
• Payment: Stripe processes payments. Prices exclude taxes unless shown otherwise. Except where the law requires, payments and used credits are not refundable.

Your content

You own the content you bring to Electre and, as between you and us, the output your agents produce for you. You give us the licence we need to host, process, transmit and display that content solely to provide and secure the service. You confirm you have the rights to the content you provide.

Acceptable use

You must not use Electre, or have its agents or published apps engage in:

• Unlawful use: breaking the law or infringing anyone’s rights, including intellectual property and privacy.
• Attacks: distributing malware, phishing, scanning or attacking networks, or evading security controls, including our sandbox and network limits.
• Platform abuse: spam, cryptocurrency mining, reselling access, getting around usage limits or overloading the service.
• Harmful content: content that exploits children, incites violence or harassment, or deceives people about who they are dealing with.

Apps you publish

You are responsible for apps you publish, their content, their users and your compliance with the laws that apply to them, including privacy law. We may suspend an app that breaches these Terms, risks harm, or runs out of hosting credit.

Third-party services

Electre connects to services such as Google, GitHub, Stripe and AI model providers. Their own terms govern your use of them, and we are not responsible for them.

Changes and availability

We improve Electre continuously and may change or discontinue features. We aim for high availability but do not promise uninterrupted service. We will give reasonable notice of material changes to these Terms; continuing to use Electre after they take effect means you accept them.

Suspension and closure

You may close your account at any time. We may suspend or close an account that breaches these Terms, creates risk, or is unpaid, with notice where reasonable. On closure you can ask us to export your content within 30 days, after which we delete it as described in the Privacy Policy.

Warranties and liability

Nothing in these Terms excludes rights you have under the Australian Consumer Law or other law that cannot be excluded. Otherwise, Electre is provided as is, and to the extent the law allows we exclude implied warranties.

To the extent the law allows, we are not liable for indirect or consequential loss, lost profits or lost data, and our total liability for any claim is limited to the amounts you paid us in the 12 months before it arose. Where the Australian Consumer Law applies, our liability for failing to meet a consumer guarantee is limited to supplying the service again or paying the cost of having it supplied again.

Indemnity

You will cover our reasonable losses from claims by others arising from your content, your published apps or your breach of these Terms.

Governing law

These Terms are governed by the laws of Australia, and courts in Australia have jurisdiction. Questions go to hello@electre.ai.
